Understanding the L-1 Visa
Traditionally, the L-1A and L-1B visa categories were used by multi million dollar companies to transfer executives and managers to the United States. Smaller, specialized businesses could not as easily participate in the L-1 program even though a need existed for them. However, the development of technology and the breaking down of trade barriers has allowed small businesses to insert themselves in the competitive global marketplace.
Now, the L-1A and L-1B visa categories allow multi national companies to transfer managers, executives, or employees with "specialized knowledge" from a foreign country to the United States. In allowing a company to bring a foreign national to work in the United States, companies can take advantage of their talent pool and strengthen their competitive advantage both at home and abroad. However, this transfer can only take place if the executive, manager or employee worked for the multi national company for at least one year out of the last three years.

The L-1A and L-1B visa represent important advantages over the H-1B visa. For example, the spouse of an L visa holder may work in the United States under the L-2 visa category. The final advantage of the L-1 visa over the H-1B visa is the fact that the L-1 visa is not subject to statutory numerical caps such as is the H-1B visa.
