Who Is Eligible for an Asylum Work Permit?
When you apply for asylum, you can also apply for employment authorization while your case is pending approval. If your work permit is approved, you will be able to work in the U.S. while you wait for a decision on your case.
To be eligible for an asylum work permit:
- You must currently be waiting on a decision for your asylum application from USCIS within 365 days of the immigration office receiving your application.
- If there is a delay in your application processing, it must not be due to a mistake you made. The USCIS must be the one responsible for any delays.
If your asylum application has already been approved, you do not need to apply for a work permit and are automatically authorized to work in the country.
How Do I Apply for an Asylum Work Permit?
You must complete Form I-765 with the supporting documents and pay the required fees. If the USCIS approves your application, you will be notified and sent an employment authorization document.
