E-1 Treaty Trader Visa Eligibility Requirements
E-1 visas are available to foreign traders who meet certain qualifications.
Individuals who want to apply for the E-1 visa must:
- Be from a country that holds a current treaty of commerce and navigation with the U.S.
- Work in a substantial trade that qualifies for the E-1 classification.
- Engage in trade principally between the U.S. and treaty country
- Be in a supervisor or executive role
It is important to note that ordinary skilled or unskilled workers are ineligible for the E-1 visa. This type of visa is only awarded to foreign employees in supervisory or executive positions and those with specialized skills that are essential to the efficient operation of the business.
E-2 Treaty Investor Visa Eligibility Requirements
E-2 visas are for individuals who qualify as treaty investors under immigration laws.
Individuals who want to apply for the E-2 visa must:
- Be coming to the United States to invest a significant amount of money in a U.S.-based enterprise.
- Be of a supervisory or executive role that directs and develops the enterprise.
- Must be a citizen of a country that has a treaty of commerce with the U.S.
Those who are approved for the E-2 visa can remain in the U.S. for two years.
Can E-2 Visas Be Renewed?
There is no limit on the number of times an E-2 visa can be renewed as long as you can demonstrate the need for the business.
Each time it is renewed, it is only good for two years.
E-2 Visa Benefits for Family Members
The E-2 visa also provides benefits to family members who accompany the visa holder:
- Spouse of visa holder can obtain authorization to work in the U.S.
- The unmarried children under 21 of visa holder can live and study in the U.S.
