Who Qualifies for Asylum?

Once within the States, you can petition for asylum if you have reason to fear for your safety within your own country. You must have been persecuted, or must have reason to fear persecution, based on your race, nationality, religion, political group, social group, or gender. Importantly, your country must also be unwilling or unable to protect you. If all of these are true, you may qualify for asylum within the United States.

Obtaining Asylum: What’s Next?

In order to obtain asylum, you must already be within the United States. If you are outside the U.S., you must petition as a refugee.

There are time restrictions for potential asylum applicants. As a rule, all asylum seekers must apply for asylum within one year of entering the United States, after which point, their petition may be invalid. Additionally, if the applicant has a criminal background, attaining asylum may be more challenging.
