Individuals and families often seek asylum in the United States if they fear persecution in the country they previously lived. Asylum is meant to protect folks from any harm intended based on race, gender, religion, nationality, or group membership. If you or someone you love qualifies for asylum, we urge you to reach out to our team.

Who Is Eligible to Apply for Asylum or Refugee Status?
To be eligible for asylum or refugee status, you must be able to show the following:
- You are a victim of persecution and fear for your own safety in your home country.
- Your home country is unwilling or unable to protect you
- You have been persecuted, or have reason to fear persecution, based on your race, nationality, religion, political group, social group, or gender
There are time restrictions for potential asylum applicants. As a rule, all asylum seekers must apply for asylum within one year of entering the United States, after which point, their petition may be invalid unless they can prove certain exceptions. Additionally, if the applicant has a criminal background, attaining asylum may be more challenging.
Difference Between Asylum vs. Refugee Status
The difference between refugee and asylum status is simply where you are located when you submit your application.
If you are physically in the United States, you apply for asylum status.
If you are outside the United States, you apply for refugee status.
How Long Does the Asylum Process Take?
The entire asylum process can vary, sometimes taking 6 months to several years. The reason it can take so long is due to the extensive paperwork and procedures required of applicants, as well as the current backlog in immigration courts. This backlog has caused delays in application decisions and has prolonged the separation of families.
To help ensure that your application goes smoothly, work with an experienced immigration attorney.
